Welcome to Solqavi. These Terms of Use govern your access to and use of our online masterclass platform, including all content, features, and services offered through solqavi.digital. By accessing or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, enrolling in courses, or accessing any part of our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you may not use our services.

2. Eligibility

You must be at least 16 years of age to use our platform. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are accessing our platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of our platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities that occur under your account

4. Course Enrollment and Access

4.1 Course Availability

We offer masterclasses on various topics related to version control systems and programming. Course content, instructors, pricing, and availability are subject to change without notice. We do not guarantee that any specific course will be available at any given time.

4.2 License to Access Content

Upon enrollment and payment, we grant you a limited, non-exclusive, non-transferable license to access and view course content for your personal, non-commercial use. This license does not include the right to:

  • Download, copy, or reproduce course materials except where explicitly permitted
  • Distribute, sell, rent, or sublicense course content to third parties
  • Modify, create derivative works, or reverse engineer any platform features
  • Remove copyright notices or proprietary markings from course materials
  • Use content for commercial purposes or training others without authorization

4.3 Access Duration

Unless otherwise specified, access to enrolled courses is provided for the duration stated at the time of purchase. We reserve the right to modify access periods, discontinue courses, or update content at our discretion.

5. Payment and Refunds

5.1 Pricing and Payment

Course prices are displayed in the currency indicated on our platform. You agree to pay all fees associated with your course enrollments. Payment must be made through our approved payment methods. All prices are subject to change without notice.

5.2 Refund Policy

Refund requests must be submitted within the timeframe specified for each course. We evaluate refund requests on a case-by-case basis. Refunds may be denied if you have accessed a substantial portion of the course content or violated these Terms. Processing time for approved refunds may vary depending on your payment method.

5.3 Subscriptions

If you purchase a subscription, you authorize us to charge your payment method on a recurring basis until you cancel. Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.

6. User Conduct

You agree to use our platform responsibly and in compliance with all applicable laws. You will not:

  • Violate any local, national, or international laws or regulations
  • Infringe upon intellectual property rights of Solqavi or third parties
  • Upload or transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems or user accounts
  • Engage in any form of harassment, abuse, or threatening behavior
  • Impersonate others or misrepresent your affiliation with any entity
  • Scrape, data mine, or use automated tools to extract platform content
  • Interfere with the proper functioning of our platform or services
  • Share course access credentials or facilitate unauthorized access
  • Post or transmit spam, advertising, or promotional content without permission

7. Intellectual Property Rights

7.1 Platform Content

All content on our platform, including but not limited to text, graphics, videos, logos, course materials, software, and design elements, is owned by Solqavi or our licensors and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and branding may not be used without prior written permission.

7.2 User-Generated Content

If you submit, post, or share content on our platform, including comments, questions, or feedback, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating and improving our services. You represent that you have all necessary rights to grant this license and that your content does not violate any third-party rights.

8. Third-Party Links and Services

Our platform may contain links to third-party websites, services, or resources. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of service of any third-party sites. Your interactions with third parties are solely between you and such third parties.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

We strive to maintain uninterrupted access to our platform but do not guarantee that our services will be available at all times. We may suspend or discontinue services temporarily or permanently for maintenance, updates, or other reasons without prior notice. We are not liable for any interruption, delay, or unavailability of services.

While we aim to provide accurate and high-quality educational content, we make no warranties regarding the completeness, accuracy, reliability, or suitability of course materials. Course content represents the views and expertise of individual instructors and does not necessarily reflect the views of Solqavi. You are responsible for evaluating the suitability of any content for your purposes.

9.3 Limitation of Liability

To the maximum extent permitted by law, Solqavi and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our platform. Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim.

9.4 As-Is Basis

Our platform and services are provided on an as-is and as-available basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless Solqavi and its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or related to your use of our platform, violation of these Terms, infringement of any third-party rights, or any content you submit or share.

11. Privacy and Data Protection

Your use of our platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the data practices described in our Privacy Policy. We implement reasonable security measures to protect your information but cannot guarantee absolute security.

12. Modifications to Terms

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at support@solqavi.digital. Upon termination, your access to course content and platform features will be revoked, subject to any remaining access periods for purchased courses.

13.2 Termination by Us

We reserve the right to suspend or terminate your account and access to our platform at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or conduct that we deem harmful to our platform, users, or business interests. Termination may result in the loss of access to course content without refund.

13.3 Effect of Termination

Upon termination, provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, disclaimers, limitations of liability, and indemnification obligations.

14. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of our platform, we encourage you to contact us first to seek an informal resolution. Both parties agree to make good faith efforts to resolve disputes amicably before pursuing formal legal action.

15. General Provisions

15.1 Entire Agreement

These Terms of Use, together with our Privacy Policy and any additional terms specific to certain features or courses, constitute the entire agreement between you and Solqavi regarding your use of our platform.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Solqavi.

15.4 Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, labor disputes, or technical failures.

16. International Use

Our platform is accessible to users worldwide. You are responsible for complying with all applicable local laws and regulations in your jurisdiction. If you access our platform from outside Oman, you acknowledge that you are doing so at your own initiative and are responsible for compliance with local laws.
